Chick-fil-A is claiming that consumers
are confused between its slogan “Eat Mor Chikin”
and a Vermont artist’s “Eat More Kale” t-shirts.
But who can’t tell the difference between chicken and kale?

I didn't read the article, but to answer your question, no. In this case, I see no infringement. How can anyone claim the right to the words "Eat More" whatever? If I were the artist, I would worry about it and kindly tell Chick-fil-a to fuck-off-a.
This is same McDonald's have been doing for years. "Mc-anything" was chased down by corporate lawyers.
There was a tax preparation guy in my home town in CA who had a business called McTax. McDonald's harassed him into changing the name.

In the latest development to stem from "Ducky Dynasty" star Phil Robertson's

and subsequent suspension from A&E (http://www.huffingtonpost.com/2013/12/18/phil-robertson-duck-dynasty_n_4469887.html),
an unnamed group has launched "Chick-Phil-A" day (http://www.kpho.com/story/24308802/national-chick-phil-a-day-movement-starting-on-facebook),
encouraging Robertson supporters to wear
"Duck Commander or camouflage gear"
and "eat at Chick-fil-A" on Jan. 21.
Organized through Facebook (https://www.facebook.com/chickphiladay), the group claims
that it has no affiliation with Chick-fil-A or Phil Robertson,
but is "independent and organized from a grassroots view."

that the event "is in no way sponsored by or

I like kale just fine. Collard greens, brussels sprouts, broccoli and okra are tasty as well.
JJ Kale is my favorite. John Kale, not so much.
