US District Court for Maine Issues Order Granting Summary Judgment against Glenn Baxter, K1MAN
On January 10, the US District Court for Maine issued a ruling in the FCC's lawsuit to collect monetary forfeitures issued to Glenn Baxter, K1MAN, of Belgrade Lakes, Maine. The FCC had assessed forfeitures in the amount of $21,000 against Baxter (http://www.arrl.org/news/us-charges-k1man-with-failure-to-pay-fine) on three asserted violations of the Communications Act of 1934 and its regulations: Failure to respond to an FCC inquiry in violation of Title 47, Section 308 of the US Code (http://www.law.cornell.edu/uscode/html/uscode47/usc_sec_47_00000308----000-.html), willful or malicious interference with other radio transmissions in violation of Section 97.101(d) (http://ecfr.gpoaccess.gov/cgi/t/text/text-idx?c=ecfr&sid=47ae9117aa64a743f2bdfb3db7c32da6&rgn=div8&view=text&node=47:5.0.1.1.6.2.157.1&idno=47), and engaging in communications in which he has a pecuniary interest in violation of Section 97.113(a)(3) (http://ecfr.gpoaccess.gov/cgi/t/text/text-idx?c=ecfr&sid=47ae9117aa64a743f2bdfb3db7c32da6&rgn=div8&view=text&node=47:5.0.1.1.6.2.157.7&idno=47).
Chief US District Judge John A. Woodcock Jr, in writing for the Court, agreed with the FCC on the first two counts -- willful or repeated failure to respond to FCC requests for information, and willful or malicious interference -- and granted summary judgments to the FCC in the amount of $3000 and $7000, respectively. On the third claim -- communications in which an amateur station licensee or control operator has a pecuniary interest -- the Court declined to grant a summary judgment to the FCC, holding that there were issues of material fact to be litigated in the Court in later proceedings. Well... as has been pointed out elsewhere, this is a hit, a big hit. But not neccesarily a fatal hit.

Sooner or later, though, the issue of his pending license renewal will come into play. If I understand the procedures correctly, and I may be wrong... if Baxter doesn't pay the fine, his renewal will not be processed. Right now, I believe it's still in "limbo".

At some point, one would think that the non-payment would move the renewal into the "fuggedaboudit" category. But once the lawyers get involved, you never know.

I had a psk qso with a gent who had a call very similar, and he always has issues with people not wanting to have a qso because of it.

Certain calls will produce tens of thousands of potentially embarrassing hits because of their previous holders. The FCC should have a program to permanently retire certain abused calls, or at least put them on ice until a couple of decades have passed! :)

Since the FCC has not begun sequentially reissuing the currently unassigned K & W 1x3 calls, I wouldn't worry about this one for quite awhile.

Let's face the reality. Baxter will be broadcasting on the air until the day he dies or until they physically cart his equipment away and toss him into jail. People like Baxter live in their own deluded world. As far as Baxter is concerned he has done no wrong. As far as he is concerned the FCC, and everyone else is wrong and he is right. He will simply ignore any fines or judgments against him and keep on doing his thing as he has been. And why shouldn't he ? So far it is working very well for him.

I must be fortunate in that I usually don't hear the 75M version of this garbage but its 20M counterpart renders 14.275 all but useless for me. :roll:

Now if I understand correctly if he does'nt pay the fine by the 22nd of march his licence renewal becomes null and void and he'll no longer be legally permitted to operate as an Amateur radio station ...... everyone kiss K1MAN goodbye? :pray:

The operative word here is supposedly, he claims it's illegal as long as the case is in litigation (he's right on that, Cheryl's letter was wrong) and doncha know, he'll keep it in litigation until the cows come home. Tomorrow will tell, keep checking the database and frankly I wouldn't be surprised if he keeps right on truckin' anyway.

No, he's probably not going to stay on air with his call if they cancel his license. What he may end up doing is enlisting the help of friends and doing a phone patch. The bulletins will continue, just not under that callsign.

It's a throwback to the he early Geocities day where there was page after page after page of horrific looking web pages coded by people who had no the vaguest idea of what they were doing.
