Absolutely. But refusal to do so does not amount to an excuse for the police to beat the crap out of somebody who is not putting up a fight.

Yes, but a total of 5 Dallas police officers will be facing felony charges on the state level, end of police career.
And the FBI is involved as an added bonus.
It does not matter if anyone gets convicted, it is over for them.
